Informed Consent Document

PARTICIPANT’S RELEASE, WAIVER, AND DISCHARGE OF ALL CLAIMS, DAMAGES, AND LIABILITY AGAINST FREEWALKERS, INC. (“Freewalkers”) AND ACKNOWLEDGMENT OF PERSONAL RESPONSIBILITY AND ASSUMPTION OF RISK (“Release”). In consideration of my participation in any event offered, hosted, or co-hosted by Freewalkers (“Events”), I (“Participant”) agree, acknowledge, and accept:

Participant may be injured (“Injury”) through exposure to a variety of hazards, dangers, and risks, whether foreseen or unforeseen, that are inherent in walking and hiking, whether through natural causes or activities of others, including but not limited to, pedestrians, animals, vehicles, other participants, fixed or moving objects, surface hazards, equipment failure, inadequate safety equipment, and weather conditions.

  1. Rescue or medical personnel or facilities to treat any Injury may not be available and Freewalkers is not responsible to seek or obtain such personnel or facilities to treat any Injury.

  2. To the fullest extent allowed by law, Participant hereby RELEASES, WAIVES, and DISCHARGES and agrees not to sue FreeWalkers and their respective officers, trustees, employees, agents, and volunteers (collectively, “Releasees”) from any and all claims, damages, and liability on account of, or in any way resulting from any Injury, even if caused by negligence of the Releasees.

  3. Participant will hold harmless and indemnify the Releasees from any claims, damages, or liability caused by Participant’s negligence in any event.

  4. Participant understands and intends that this Release is binding upon Participant’s heirs, executors, administrators and assigns, and includes any minors accompanying Participant in any Event.

  5. Participant understands that this Release is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision is held to be invalid or legally unenforceable for any reason, the remainder of this Release shall not be affected thereby and shall remain valid and fully enforceable.

  6. Participant has read this document in its entirety and freely and voluntarily assumes all risks of Injury and resulting damages, notwithstanding such risks, while participating in any Event.

  7. Participant grants Freewalkers the right to use Participant’s image, name, likeness, and voice related to any event for any lawful purpose and waives any right to inspect or approve such use.
